An unauthorised encampment can halt site operations, deter customers, and leave the landowner facing clean-up and fly-tipping costs that grow by the day. The good news: a private landowner does not have to wait weeks for a court date to recover their own land.

The Common Law route: action in about 24 hours

Under Common Law, a landowner may recover possession of their land using no more than reasonable means. Acting as your agents, we:

  1. Attend and assess the same day, confirming occupation, numbers, vehicles and access points, and carrying out welfare checks.
  2. Serve a formal direction to leave on the occupants, with a clear deadline.
  3. Return to enforce. Our teams oversee a calm, controlled departure and liaise with local police where appropriate.
  4. Secure the site with height barriers and bunds, or patrols and guarding, so the land does not simply refill next week.

Where a court order is the sounder route, for example on particularly sensitive sites, we manage possession proceedings under CPR Part 55 and enforce the resulting order.

Lawful, proportionate, documented

Encampment removal is scrutinised, and rightly so. Our agents conduct welfare checks, treat occupants with courtesy, use no more force than the law permits, and record every attendance. You receive a full written and photographic report, which protects your position if conduct is ever questioned.

Do I need a court order to remove travellers from private land?+

Not usually. Where the occupation is a trespass on private land, the common law right to recover possession allows removal without court proceedings, which is why the timescale is hours rather than weeks. Where the circumstances require the court route instead, we will tell you at the outset rather than after attending.

How quickly can you attend?+

Typically within about 24 hours of instruction. Every day of occupation carries cost in lost use, damage and clean-up, so speed is the point of the exercise.

Is welfare taken into account?+

Yes, and it matters practically as well as ethically. Attendance is carried out proportionately and documented throughout, with welfare considerations recorded. A removal carried out badly invites challenge; one carried out properly and evidenced does not.

What happens to the site afterwards?+

Clearance and securing the site are separate from the removal itself, and we will set out what is involved once the land has been assessed. Pairing removal with site security is usually what prevents a return.
